Impacts of constitutional and legal changes from 2020 on the functioning of the judiciary in Slovakia

At the end of 2020, an extensive amendment to the Constitution of the Slovak Republic was approved, which mainly concerned the judiciary. These constitutional changes were followed by changes in the current legislation in the field of the judiciary, while further changes in the legal regulation are under discussion. The method of creation of the Constitutional Court and some of its powers have changed. The Supreme Administrative Court is established as a new judicial body. The changes also affected the Judicial Council as a constitutional body of judicial legitimacy. Some judicial opinions of the Constitutional Court are being overruled by an amendment to the Constitution. Recent legislative changes raise a whole range of different issues, not only in the field of constitutional law. It is the task of academics to seek answers to these questions across branches of law, which is also the ambition of this section.
