Business Sustainability and Responsibility in Commercial Law: Legislative, Jurisprudential, and Corporate Contexts
This section deals with the normative and systemic integration of aspects related to the issue of business sustainability and its reflection in commercial law. It focuses on the evolving legal environment governing sustainable business conduct, legislative changes, trends in case law, and the impact on corporate governance and internal decision-making processes. Emphasis is placed on how sustainability expectations affect the obligations of corporate bodies, particularly in relation to professional (due) diligence, risk management, prioritization of stakeholder interests, and long-term strategic orientation.
The section welcomes scientific contributions dealing with legislative and judicial approaches to the regulation of sustainable business, the scope and content of related obligations of management or supervisory bodies in commercial companies. Contributions reflecting current trends in the case law formation of standards of obligations related to climate protection, the environment, and human rights, especially where these decisions—although arising at the level of public law obligations—have the potential to indirectly influence the scope of care, responsibility, and obligations of private sector entities.
