Intersections and Differencies of Criminal and Administrative Sanction Mechanism – Direction Towards Individualism or Cooperation?

Criminal and administrative law exist as two separate law fields. However, their overlap in the area of sanctioning is obvious, while the existence of separate mechanisms in the area of substantive and procedural law creates a problematic legal environment in particular cases, when it is uncertain how to apply the elements of substantive liability and the procedural aspects in cases on the border between administrative and criminal law. The aim of the section is to find the answers how to set up and coordinate the mutual functioning of these separate mechanisms in order to create a mutually complementary environment in which legal certainty will dominate.
